قد ينجم الضرر في بعض الأحيان عن خطأ شخص غير محدد، وإن كان ينحصر في مجموعة محددة من الأشخاص، بحيث إذا بدا من المشكوك فيه نسبة هذا الخطأ إلى شخص بعينه، إلا أن بالإمكان- مع ذلك- القطع بأنه ناجم من بين هذه المجموعة لا يخرج عنها.
وتحديد إطار البحث في هذه المشكلة، يقتضي أن نستبعد منها أولاً الفرض الذي يكون فيه أحد الأشخاص مسئولاً قانوناً عن السلوك الخاطئ لكل أفراد المجموعة، بحيث لا تكون هناك أهمية لتحديد الشخص بالذات الذي أحدث الضرر من بينهم. كما هو الحال فيما يتعلق بكل من: متولي الرقابة، والمتبوع، فمن يجب عليه، قانوناً أو اتفاقاً، رقابة عدة أشخاص، في حاجة إلى الرقابة بسبب القصر أو الحالة العقلية أو الجسمية لكل منهم، يكون ملزماً بتعويض الضرر الذي يحدثه أي منهم للغير بعمله غير المشروع (م/173). كما يكون المتبوع مسئولاً عن الضرر الذي يحدثه أي من تابعيه، بعمله غير المشروع، متى كان واقعاً منه حال تأدية وظيفته أو بسببها (م/174 مدني)، بحيث يكفي أن يقيم المضرور الدليل على أن المجموعة التي من بينها المتسبب في الضرر، تقع تحت رقابة أو تبعية المسئول، حتى ولو لم يتمكن من تحديد ذاتية هذا المتسبب، ثانياً الفرض الذي يكون فيه كل أفراد المجموعة مخطئاً، بالمعنى الذي ورد بشأنه نص المادة/169 مدني مصري، وهو فرض المسئولية التضامنية.
وفي هذا الإطار المحدد، نعرض لهذه المشكلة، مقسمين البحث فيها إلى بابين: تخصص أولهما لبحث مدى إمكانية تعويض المضرور في ضوء القواعد العامة للمسئولية المدنية، فإذا ما بدا أن الطريق إليه تكتنفه- في ضوء هذه القواعد عقبات قانونية ليس من السهل اجتيازها، انتفائا إلى بحث مدى إمكانية هذا التعويض في ضوء فكرة الشخصية الاعتبارية، وهو ما نخصص له الباب الثاني من هذه الدراسة.
