تلاحقت في السنوات الأخيرة التعديلات والإصلاحات التي أدخلها المشرع الفرنسي على قانوني الإجراءات الجنائية والعقوبات، وأهم هذه التعديلات القانون رقم 99-515 في شأن بدائل الدعوى الجنائية وتدعيم فعالية الإجراءات الجنائية. وقبل ذلك وبعدة أشهر قام المشرع المصري بتعديل قانون الإجراءات الجنائية بمقتضى القانون رقم 174 لسنة 1998.
ونظراً لأهمية التعديلات التي أدخلها كل من المشرع على قانوني الإجراءات الجنائية في مصر وفرنسا رأينا أن نتناول الصلح والأمر الجنائي في كل من البلدين بالدراسة في ضوء التعديلات التي أدخلها المشرع على قانوني الإجراءات الجنائية في البلدين، وخصوصاً لحداثة هذا الموضوع، وما يلاحظ وبصفة خاصة في فرنسا من اتجاه شديد نحو النظام الانجلوأمريكي في مجال التفاوض للوصول إلى اعتراف المتهم بارتكاب النشاط الإجرامي وإيجاز الإجراءات ووضع نهاية للدعوى الجنائية قبل تحريكها. ولن نتعرض بالدراسة للصلح في القوانين الخاصة نظرا لوجود عدد كبير من الدراسات في هذا المجال، ولكننا سنعرض للصلح والأمر الجنائي وفقا للنصوص الجديدة والمعدلة التي أدخلها كل من المشرع المصري والفرنسي على قانونه الوطني مع عرض الطبيعة القانونية لهذين النظامين وتقييمهما. وسوف نتناول بالدارسة في فصلين متتالين الصلح ثم الأمر الجنائي.
