تعتبر الأحكام الجنائية المرحلة الأخيرة في سير الدعوى الجنائية، وقد اخذ المشرع المصري بمبدأ تدرج الأحكام والمحاكم التي تصدرها بحسب الجريمة - كنوع من الضامنة للمتهم - حتى وصل إلى صدور الحكم بغير محاكمة علنية أو تحقيق في الجرائم البسيطة التي يكتفي فيها بعقوبة الغرامة، وهو ما أطلق عليه المشرع الأمر الجنائي، وقد توسع المشرع أخيراً توسعاً ملحوظاً في الجرائم التي تخضع لهذا النظام بالقانونين 74، 157 لسنة 2007.
ونظراً لأهمية نظام الأمر الجنائي فقد بادر الأستاذ العزيز "محمد الصعيدي" رئيس المحكمة بإعداد بحث قيم تناول في الأمر الجنائي منذ أن بدء الآخذ به في القانون المقارن والقانون المصري مبيناً وجهات النظر المختلفة وتعرض لمعظم المشاكل القانونية التي تعرض في العمل القضائي وأبدي فيها الرأي الصائب.
