يجب أن يحكم كل قانون يرعى الإجراءات الجزائية إعتباران: الإعتبار الأول هو تأمين الأمن والإستقرار في المجتمع لأن قانون الإجراءات الجزائية، المتلازم مع قانون العقوبات، هو الذي يؤمن لهذا الأخير فعالية تطبيقه، فهو يشكل ذراعه التطبيقي، وبدونه يغدو قانون العقوبات مجرداً من أي فائدة عملية.
والإعتبار الثاني هو الموازنة بين ضرورات الأمن والإستقرار من جهة، وحرية المواطن وإطمئنانه من جهة أخرى، فلا يقتضي أن يطيح أحد الإعتبارين بالآخر، لا تهدر حرية المواطن بإسم الأمن والإستقرار ولا يهدد الإستقرار الإجتماعي بإسم الحرية الشخصية.
يتطرق هذا الكتاب إلى مختلف نواحي قانون الإجراءات الجزائية، بدءاً من مرحلة التحري والإستقصاء، حيث يقتضي أن يتقيد مأمورو الضبط القضائي، خلال هذه المرحلة بالقواعد القانونية الإلزامية التي تؤمن صحة التحقيق وحرية المواطن في آن واحد.
ويقتضي أن تقوم النيابة العامة بدورها الصحيح خلال مرحلة التحقيق وصولاً إلى مرحلة المحاكمة، حيث يقتضي أن تسود المبادئ العامة التي ترعى الإجراءات الجزائية لا سيما: العلانية، الوجاهية، والشفوية، توصلاً إلى التوفيق بين تأمين حقوق الدفاع وكشف الحقيقة، ألا يشكل هذان الإعتباران غاية قانون الإجراءات الجزائية؟...
