لا مراء فى أن التصدى للجزاء الإجرائى من الصعوبة بمكان. بالنظر إلى أهمية الموضوع ودقته وصعوبة صياغته، ومبعث أهميته وخطورته أن كل تفعيل للجزاء الإجرائى يعنى عدم تفعيل القاعدة الموضوعية، ومن ثم إفلات المذنب بجرمه، وضياع حق الدولة فى العقاب. أما إذا فعلنا القاعدة الموضوعية على حساب القاعدة الإجرائية، ظهرت مشكلة الافتئات على الحقوق والحريات الفردية من خلال إهدار الضمانات والقيود التى استلزمها القانون عند مباشرة الأعمال الإجرائية، ومن هنا تعن الحاجة إلى وجوب تحقيق هدفين غاية فى الأهمية، الأول يتمثل فى ترشيد الإجراءات وصولاً إلى عدالة فعالة عن طريق تفعيل كل من القاعدتين الموضوعية والإجرائية دون افتئات أى منهما على الأخرى، ولن يتم ذلك إلى من خلال تفادى اتخاذ العمل الإجرائى معيباً للحيلولة دون وقوعه فى شرك الجزاء الإجرائى، أما الهدف الثانى فيتمثل فى وجوب حماية الحريات والحقوق الفردية من أن تكون محلاً سائغاً لجور السلطة وتعسفها، ولن يتم ذلك إلا من خلال تبنى "إجراءات بصيرة" تحترم حقوق وحريات الطرف الضعيف فى الرابطة الإجرائية.
ويقتضى بحث ذلك الموضوع الاعتماد على المنهج الاستقرائى وذلك فى محاولة لجمع شتات هذه الفكرة وجزئياتها، والبحث حول كل ما يتعلق بجوانبها فى المجال الفقهى سواء أكان ذلك على صعيد الفقه العربى أم الفقه المقارن، وبمراعاة عدم اغفال المنهج الاستنباطى أيضاً مع مواكبة ذلك بمحاولة اطلاع شاملة لغالبية أحكام محكمة النقض، وتتكون الدراسة من مبحث تمهيدى: مدخل لدراسة النظرية العامة للجزاءات الإجرائية فى قانون الإجراءات الجنائية، الباب الأول: الأعمال الإجرائية، الباب الثانى: ماهية الجزاء الإجرائى وأسبابه، الباب الثالث: النظام القانونى للجزاء الإجرائى.
