نظراً لأهمية الحماية القانونية للتجارة الإلكترونية وضعت لجنة الأمم المتحدة للقانون التجاري الدولي مشروعاً لقانون موحد للتجارة الإلكترونية، كما قام الإتحاد الأوروبي بوضع مشروع مشابه، وصدرت مجموعة من التوصيات عن البرلمان والمجلس الأوربي. كما صدرت عدة قوانين للتجارة الإلكترونية في دول مختلفة، وقد شعرت مصر من جانبها بأهمية موضوع التجارة الإلكترونية، وتنظيمها من الناحية القانونية فتم مؤخراً تشكيل لجنة لدى مركز المعلومات ودعم اتخاذ القرار التابع لمجلس الوزراء لإعداد مشروع قانون للتجارة الإلكترونية، وقد تم إعداد مشروع أولي حيث تم عرضه على الجهات المعنية لإبداء الرأي فيه، وسنتناول في هذا البحث بالدراسة تعريف التجارة الإلكترونية وصور الحماية القانونية غير الجنائية لها في فصل تمهيدي، ثم نتناول الحماية الجنائية لموقع التجارة الإلكترونية ومحتوياته على الإنترنت في باب أول ثم نعرض في الباب الثاني للحماية الجنائية للبيانات الإسمية وأخيرا نتناول في الباب الثالث الحماية الجنائية للمعاملات المالية بطريق التجارة الإلكترونية.
