موضوع الدراسة هو الحرية الفردية وهى جزء من الحريات العامة التى أولتها الأديان وإعلانات الحقوق والاتفاقيات الدولية والدساتير والقوانين عناية خاصة, ووضعت الأحكام والقواعد الخاصة بتنظيماتها وحمايتها ولم تسمح بتقييدها إلا لضرورة حماية أمن المجتمع أو اقتضاء حق العقاب. وكان من أهم المبادئ التى تضمنها النظام الإجرائى الإسلامي مبدأ ضمان الحرية الشخصية للفرد, فقد كانت حماية الإنسان وكفالة حرياته وحقوقه الأساسية موضع اهتمام الشارع الإسلامى.
وتقتضي حماية هذه الحرية وكفالتها عدم المساس بها إلا لضرورة تقتضيها مصلحة المجتمع فى حماية أمنه أو اقتضاء حقه فى العقاب, وإذا اقتضت هذه الضرورة المساس بالحرية فيجب أن تكون هناك الضمانات التى تكفل عدم العصف بهذه الحرية-سواء كانت ضمانات دستورية أو قانونية- لإحداث التوازن بين الحقوق والحريات الفردية وبين مصلحة الدولة فى حماية أمنها وسلامتها واقتضاء حقها فى العقاب, وأداة هذا التوازن هى التنظيم الإجرائى فى كل دولة, ويتوقف الحق فى العقاب على الفكر السياسي الذى يحكم السياسة الجنائية.
