تركز الحماية الجنائية للحياة الخاصة في مواجهة إساءة استخدام بنوك المعلومات علي تحديد ماهية الحياة الخاصة، نطاقها وطبيعتها القانونية ومضمون الحق في أن يعيش الإنسان في عزلة عن الغير أي بعيداً عن تدخل الغير وبمنآي عن العلانية، ويبنى علي عذا التحديد وضع شكل الحماية الجنائية التي يجب أن يضيقها المشرع علي هذا الحق ضماناً لحمايته من أخطار بنوك المعلومات والتي تكاد تنحصر في أمرين، الأول: الاستقصاء أو البحث عن البيانات بوسائل شتي، وكيفية الحصول عليها. أما الأمر الثاني: فهو إفشاء أو إساءة استغلال هذه البيانات بعد معالجتها، ويتحقق ذلك بإعلانها للغير سواء الفرد أو الدولة، أو استخدامها في غير الغرض المخصص لها، والغاية من دراستنا في هذا البحث، وهي حماية الحياة الخاصة للإنسان كحق من حقوق الإنسان في القانون الجنائي في علاقتها ببنوك المعلومات.
وعلي هذا النحو نقسم دراستنا إلي فصلين علي هذا النحو التالي: الفصل الأول: الحق في الحياة الخاصة، الفصل الثاني: أثر بنوك المعلومات علي الحياة الخاصة، الفصل الثالث: الأحكام الخاصة بجرائم الاعتداء علي الحياة الخاصة المتعلقة بالمعالجة الإلكترونية للبيانات الشخصية في القانون الفرنسي.
