Book Description
يتضمن قانون العقوبات نوعين من القواعد: عامة تسرى على كل الجرائم وكل العقوبات, وقواعد خاصة بكل جريمة على حدة تحدد أركانها والعقوبة المقررة لارتكابها.
ويطلق على النوع الأول من القواعد القسم العام لقانون العقوبات, بينما الثانية فهى تكون القسم الخاص من قانون العقوبات. وقد أخذ المشرع المصرى بهذا التقسيم, وخصص الكتاب الأول للاحكام العامة, وجعل عنوانه "الاحكام الابتدائية", ثم تناول فى الكتب الثلاثة الاخرى أحكام القسم الخاص.
ولهذا التقسيم أهمية, اذ أن دراسة أحكام القسم العام تتضمن القواعد التى تشترك فيها كل الجرائم والعقوبات أو أغلبها, وهو ما يغنى عن تكرار دراسة هذه القواعد عند دراسة كل جريمة على حدة فدراسة أحكام الشروع أو الاشتراك مثلا عند دراسة القسم العام تغنى عن دراسة هذه الأحكام فى القتل أو فى السرقة... مادامت المبادئ الأساسية التى يقوم عليها القانون واحدة فى كل الجرائم, وقد تتضمن هذا الكتاب الجزء الأول من القسم العام ألا وهو النظرية العامة للجريمة.
