موضوع بحثنا دراسة للمركز القانوني للنيابة العامة من زاويتين (أولاهما) علاقتها بسلطات الدولة المختلفة, و(أخراهما) ما يترتب على ذلك من تحديد للوظيفة التي تقوم بها النيابة العامة في الدعوى الجنائية. وسوف يكون رائدنا في هذه الدراسة التأصيل لا النزول إلى مراتب التفصيلات, إلا عند الاقتضاء.
وسوف نقتصر في دراسة قانونية تأصيلية على عرض مركز النيابة العامة بين سلطات أو هيئات الدولة, وذلك في إطار بعض النظم التي تأخذ بمبدأ وحدة السلطات كالنظام السوفيتي, وكذلك في النظم التي تأخذ بمبدأ الفصل بين السلطات كالنظام الفرنسي, ثم نحدد مركز النيابة في مصر من هذه النظم مع تقييمها جميعاً. ومن خلال هذا البحث يتضح لنا جلياً علاقة النيابة العامة بأجهزة الدولة المختلفة في ظل مبدأ وحدة السلطة, وعلاقتها بسلطات الدولة الثلاث في ظل مبدأ فصل السلطات.
وإذا ما انتهينا من القسم الأول إلى تحديد للمركز القانوني للنيابة العامة ستتضح لنا طبيعة الوظيفة التي تقوم بها هذه الهيئة في سبيل حماية الصالح العام. وذلك من خلال الدور الذي تقوم به في مباشرة الاتهام الجنائي, هذا فضلاً عن قيامها في التشريع المصري بالتحقيق الابتدائي بصفة أصلية, ومشاركتها سلطة الحكم في وظيفتها وسيكون ذلك موضوع بحثتنا في القسم الثاني من هذه الدراسة.
