سنتناول في هذا البحث الدعوى المدنية بالمعنى الدقيق، أى دعوى المطالبة بتعويض الأضرار الناشئة عن جريمة. وهذه الدعوى لا يمكن النظر فيها إلا بمناسبة نظر الدعوى الجنائية، فهى دعوى تابعة للدعوى الجنائية، إلا أن هذه التبعية لا تقتصر على مجرد نظر الدعوى المدنية أمام المحكمة الجنائية، بل يمتد أثرها إلى تبعية في الإجراءات وفي الانقضاء، ونظراً لاختلاف الدعوى المدنية سواء الناشئة عن الجريمة أو الناشئة عن فعل ضار غير إجرامي، فقد رأينا الدعوى المدنية التبعية من حيث شروط مباشرتها، ثم من حيث مباشرتها والحكم فيها، وأخيراً من حيث انقضاؤها، على أن نسبق هذه الدراسة ببيان للتكييف القانوني للدعوى المدنية التبعية. وسوف نخصص لكل من هذه الموضوعات باباً على حدة.
وهكذا تتوزع دراستنا للدعوى المدنية على أربعة أبواب: "الباب الأول التكييف القانوني للدعوى المدنية التبعية، الباب الثاني شروط مباشرة الدعوى المدنية للتبعية، الباب الثالث مباشرة الدعوى المدنية، الباب الرابع انقضاء الدعوى المدنية".
