إن قانون العقوبات هو عبارة عن مجموعة الضوابط والقواعد التي يضعها المجتمع من أجل تحقيق الأمن والاستقرار، والقضاء على الشر ومكافحة والإجرام وردع المجرم ولقد جاء هذا الكتاب ليبحث في القانون العقوبات مفصلا في ماهية هذا القانون ومبينا مصادره والممثلة بقانون العقوبات السابقة وقانون الجزاء العثماني والقوانين الأخرى وأهم مصدر وهو الشريعة الإسلامية إضافة لذلك يتناول أهداف قانون العقوبات وخصائصه، كما يلفت النظر إلى تقسيم قانون العقوبات وعلاقته بقوانين الدولة الأخرى ويذكر الفئات المخولة بتطبيق هذا القانون ومما يبحث هذا الكتاب العلوم المساعدة لقانون العقوبات ثم يمضي للحديث عن قانون الجزاء وحدود تطبيق مبينا مدى تطبيق قانون العقوبات من حيث الزمان والمكان ثم يمضي منطلقا للحديث عن الجريمة. فيذكر أنواعها ويوضح مفهومها كما يبين أركانها التي تقوم عليها إضافة لذلك يكشف عن ظروف ارتكاب الجريمة ويبين كيفية التمييز بين الجريمة الجنائية والجريمة التأديبية وعند ذكره لتصنيف الجرائم يشير إلى تصنيف يتم أساس جساتها فتقسم إلى جنايات ومخالفات وينبه إلى ضرورة التفريق بينها جميعا كما أن هناك تقسيما آخر للجريمة يتم على أساس الركن المادي.
