Book Description
يترتب على الترقية نفع معنوي للموظف يتمثل قي شغل الموظف لوظيفة أعلى في السلم الإداري، أي زيادة سلطات المقررة لها لممارسة الوظيفة الأعلى، كما يترتب عليها كذلك- عادة- نفع مادة للموظف يتمثل في زيادة المرتب وغيره من الحقوق المالية، ومن ثم فهي بهذا المعنى تمثل حقا للموظف العام.
وإذا كانت الترقية تمثل حقاً للموظف العام في نطاق الرابطة القانونية التي تربطه بالإدارة، فإن هذا الحق يقابله واجب على الإدارة في الالتزام بحدود القانون، بحيث لا يرقى إلا من استوفى الشروط الموضوعية والشخصية.
يعني هذا أن النفع الذي يعود على الإدارة من الترقية هو حسن سير مرافقها العامة، ومن ثم، أفلا يمكننا أن نعتبر الترقية بمثابة حق للإدارة وفقا لهذا المفهوم، وبالمقابل يكون هناك واجب على الموظف العام الذي وقع عليه اختيار الإدارة في شغل الوظيفة الأعلى بألا يمتنع أو يتنازل عن الترقية مادامت الشروط اللازمة لشغل الوظيفة الأعلى تتوافر فيه ووقع اختيار الإدارة عليه؟
من هنا تبدو الفائدة من بحثنا والذي في إطاره سوف نبحث الترقية باعتبارها حقا للموظف العام، ثم مدى جواز التنازل عنها من جانب الموظف العام، وعلى ضوء ما سبق فإننا سوف نتناول موضوع بحثنا هذا من خلال فصلين اثنين: الفصل الأول: الترقية كحق للموظف العام، الفصل الثاني: مدى جواز الامتناع أو التنازل عن الترقية؟
