هناك الكثير من المشكلات والعقبات التى تواجه عملية وتأهيل المعوقين, كما أن هناك قصورا شديدا فى تناول الجانب الشرعى لعلاج هذه المشكلة, رغم أن فقهاء الشريعة الإسلامية قد اهتموا برعاية المعاقين ليس له نظير.
ونظرا لأهمية هذا الموضوع نظرا لتزايد عدد المعاقين يوما بعد يوم, رأيت أن أكتب بحثا فى هذا الموضوع وقد سميته "الحماية الشرعية والقانونية لذوى الاحتياجات الخاصة دراسة مقارنة بين الفقه الإسلامى والقانون الوضعى"
وقد قسمت هذا البحث إلى أربعة عشر فصلا على النحو التالي: الفصل الأول: مفهوم ذوى الاحتياجات الخاصة, الفصل الثانى: مفهوم المعوقين فى الفقه الإسلامى والفقه القانونى, الفصل الثالث: حجم مشكلة المعوقين فى العالم والأسباب التى تؤدى إلى الإعاقة, الفصل الرابع: أنواع الإعاقة وأهم مشكلات المعوقين, الفصل الخامس: وسائل الوقاية من الإعاقة فى الفقه الإسلامى, الفصل السادس: نظرة المجتمعات إلى المعاقين قبل الإسلام, الفصل السابع: نظرة الإسلام إلى المعوقين, الفصل الثامن: حقوق ذوى الاحتياجات الخاصة فى الشريعة الإسلامية, الفصل التاسع: حقوق ذوى الاحتياجات الخاصة فى القانون الواضعى ثم الموازنة بين هذه الحقوق فى الشريعة والقانون, الفصل العاشر: التكافل الاجتماعى ودوره فى حماية ورعاية ذوى الاحتياجات الخاصة, الفصل الحادى عشر: مدى مشروعية التكافل فى الإسلام, الفصل الثانى عشر: التكافل الاجتماعى وحد الكفاية فى الإسلام, الفصل الثالث عشر: صور التكافل فى الإسلام, الفصل الرابع عشر: التأمين الاجتماعى والضمان الاجتماعى ودورهما فى حماية ورعاية ذوى الاحتياجات الخاصة فى القانون الوضعى.
