يعتبر مبدأ عدم جواز المساس بجسم الإنسان من المبادئ التي يحترمها المشرع ويحيمها من خلال التشريعات التي تجرم المساس بالجسد دون رضاء الشخص، مما يؤكد حق الإنسان في الدفاع عن نفسه، وعن تكامله الجسدي ضد أي إعتداء يتعرض له، ونظراً لتباين إلتزامات الطبيب في العمل الطبي الذي يمارسه على جسد المريض، فإن الأمر يستوجب بيان الإلتزامات القانونية للطبيب حتى لا يخل بها، وسيتم تناول هذا الموضوع من خلال عدة مباحث لبيان أنواع الإلتزامات القانونية سواء المرتبطة بالعلاقة الطبية، أو بالأعمال الفنية أو الأعمال المادية، مع بيان أثر إخلال الطبيب بهذه الإلتزامات، وذلك على النحو التالي: (المبحث الأول: أنواع الإلتزامات القانونية، المبحث الثاني: إلتزامات الطبيب في العلاقة الطبية، المبحث الثالث: إلتزامات الطبيب في الأعمال الفنية، المبحث الرابع: إلتزامات الطبيب في الأعمال المادية، المبحث الخامس: آثار إخلال الطبيب بإلتزاماته القانونية).
