تعتبر الإرادة هي مناط الإلتزام في كل الشرائع والقوانين، وفي الواقع العملي أصبحت جميع عقود المرافق والخدمات التي تقدمها الشركات والهيئات العامة والخاصة عقود نمطية، بمعنى أنها تأخذ شكلاً نمطياً موحداً لا محل لإرادة المستهلك فيه، ولذلك تعتبر عقود الإذعان من أبشع صور الإستغلال وإملاء الغرادة المنفردة على الآخر ، حيث تقوم الجهات القائمة على تقديم الخدمات العامة للمستهلكين، بالمبالغة في ضمان تحصيل حقوقها من المستهلك دون أدنى حماية لحقوقه، وسيتم عرض لبعض الوسائل والآليات التي يمكن من خلالها توفير الحماية اللازمة للطرف المذعن سواء لإرادته أو لإستقلاله، خاصة الحماية من الشروط التعسفية التي تمليها الشركات الكبرى أو الهيئات أو أي جهات تقوم على تقديم خدمات مرفقيه للمواطنين، وتتمثل آليات الحماية من الشروط التعسفية في عقود الإذعان، في حماية الطرف المذعن في مراحل العقد المختلفة، سواء عند إبرام العقد من خلال إلزام الطرف القوي بالتبصير الكامل للطرف المذعن، أو في مرحلة تنفيذ العقد من خلال وجود جزاءات عقدية، وتحديد من يتحمل عبء الإثبات، أو تحديد القانون الواجب التطبيق، أو تحديد المحكمة المختصة بنظر النزاع، كما تتمثل الحماية في تنوع المنازعات المتعلقة بتنفيذ العقد منازعات داخلية، ومنازعات دولية، كما توجد آليات حماية تشريعية لحماية الطرف المذعن من خلال نصوص قانونية آمرة، أو وجود وسائل قانونية يحتمي بها الطرف المذعن في حالة الإعتداء على حقوقه مثل اللجوء للقضاء طلباً للحماية، وسيتم تناول ذلك من خلال فصلين: (الإطار القانوني لعقد الإذعان والشرط التعسفي، آليات حماية الطرف المذعن)، وخاتمة.
