نظراً لأهمية التأكيد على الثقة المشروعة بين طرفي العقد الطبي في ظل التطور العلمي والتقني في القطاع الطبي، لكون الطبيب في قمة هذا التطور ويملك المعرفة العلمية، علاوة على استخدامه الجهزة الحديثة في ممارسة مهنته، بينما الطرف الآخر في العقد وهو المريض المتلقي للخدمة على عكس ذلك، ولذلك أوجد القانون نظماً لحماية الطرف الضعيف في هذه العلاقة، ظهر ما يسمى الإلتزام بالتبصير، وإعمالاً له يلتزم الطبيب باعتباره الأكثر معرفة أو الأكثر سيطرة بتبصير المريض بما يخفى عليه من الأمور الفنية أو المعقدة، تحقيقاً للتوازن المعرفي بين طرفي العقد الطبي، وكان عدم التوازن المعرفي بين طرفي العقد الطبي أحد أسباب اختيار موضوع البحث، مما استوجب القاء إلتزاماً بتبصير المريض على عاتق الطبيب باعتباره الطرف القوي في العقد، وكان اختلاف الفقه حول التكييف القانوني لهذا العقد السبب الآخر في اختيار هذا الموضوع، حيث ذهب جانب الفقه للقول بأن هذا العقد يعتبر من العقود غير المسماه، وسيتم من خلال البحث إثبات أن هذا العقد أحد العقود المسماه وتقديم المبررات القانونية والشرعية لذلك، وسيتم تناول هذا البحث من خلال مبحث تمهيدي في ماهية الإلتزام بالتبصير واساسه، وفصلين هما: (النظام القانوني للإلتزام بالتبصير، وطبيعة لعقد الطبي وتطبيقات الإلتزام بالتبصير في)، وخاتمة.
