إن البحث في القضايا الطبية المعاصرة له أهمية كبيرة تتمثل في معالجة الفقه الإسلامي للقضايا المستجدة على الواقع العملي، خاصة بعد التطور الهائل في مجالات الطب المختلفة، ولما كان تشريح جثة الإنسان أحد المسائل الطبية المعاصرة كان في حاجة إلى بيان حكمه من الوجهة الشرعية شأنه في ذلك شأن باقي القضايا المستجدة على الساحة الطبية، خاصة وأن للتشريح أهمية كبيرة في عالمنا المعاصر، إذ يكاد لا يخلو مجتمع من المجتمعات المعاصرة من إجراء إحدى صور التشريح على الإنسان، وإن كنا قد استأنسنا بآراء الفقهاء القدامى في هاتين المسألتين لبيان الحكم الشرعي للتشريح إلا أن الاعتماد الأكبر كان على أقوال الفقهاء المعاصرين وفتاواهم في هذه المسألة، كما قمت ببيان موقف القانون الوضعي المصري من تشريح جثث الموتى إتمامًا للفائدة.
وقد قسمت هذه البحث إلى مقدمة، وسبعة مباحث، وخاتمة، المقدمة: أهمية الموضوع وسبب اختياره وخطة البحث، المبحث الأول: بيان حرمة المسلم ووجوب تكريمه حيًا وميتًا، المبحث الثاني: مفهوم التشريح وأقسامه، المبحث الثالث: علم التشريح في ضوء التاريخ، المبحث الرابع: موقف الفقه الإسلامي من تشريح جثث الموتى (المطلب الأول: حكم شق بطن الميتة الحامل لإخراج جنينها الحي - المطلب الثاني: حكم شق بطن الميت لإخراج ما ابتلعه من مال حال حياته - المطلب الثالث: حكم تشريح جثث الموتى في الفقه الإسلامي) المبحث الخامس: ضوابط التشريح، المبحث السادس: موقف القانون الوضعي من تشريح جثث الموتى، المبحث السابع: موازنة بين موقف الفقه الإسلامي والقانون الوضعي من تشريح جثث الموتى، الخاتمة: وتشتمل على أهم نتائج البحث.
