إذا كانت عمليات نقل الأعضاء البشرية هي الأوسع انتشارًا في الوقت الحاضر، فإنها مع ذلك لا زالت تثير جملة من المشاكل والتساؤلات. فقد ثار خلاف وجدل غير ضيق النطاق بين فقهاء الشريعة الإسلامية، وبين رجال القانون كذلك، حول مدى إمكانية إباحة مثل هذه العمليات التي تنتهك فيها عصمة جسد إنسان بتعريضه لخطر على درجة من الجسامة لا لمصلحته هو، بل لمصلحة إنسان آخر، بحيث ذهب جانب منهم إلى حظر إجرائها بصورة مطلقة، في حين ذهب جانب آخر إلى إباحتها ولكن بما لا يبتعد عن فرض عدة قيود وتطلب جملة من الشروط.
وهذا ما سوف نحاول الإجابة عليه من خلال فصلين، خصصنا الأول منهما لعرض ودراسة الآراء التي تتبنى موقف (حظر عمليات نقل الأعضاء البشرية)، أما الثاني فلعرض الآراء أو الأسس التي تتجه إلى (إباحة عمليات نقل الأعضاء البشرية)، غير أننا وبغية التوصل إلى فهم أدق لموضوع البحث سنتعرض إلى مفهوم هذه العمليات من خلال الفصل التمهيدي.
