أصبح تنفيذ الالتزام في وقته المحدد ذا ضرورة كبيرة بالنسبة للمتعاقدين، ولذلك كثيرًا ما يلجأ المتعاقدون وقت إبرام العقود إلى اشتراط الضمان في حالة عدم تنفيذ الالتزام من شخص المدين في الوقت المحدد له، أو عدم تنفيذه نهائيًا، كتعويض للضرر الذي يلحق الدائن، ويكون ذلك مقابلًا للتنفيذ العيني للالتزام الأصلي، والشريعة الإسلامية، والقانون الوضعي، تجاه تضمين الضرر الذي يصيب الدائن، قد سلكا مسلكًا موضوعيًا حيث جعلا المدين مسئولًا عن فعله الضار لأن أموال الناس معصومة، وأن الخطأ لا ينافي عصمة المحل.
وهذه الرسالة لبيان موقف الشريعة الإسلامية من اشتراط الضمان وإن كان أساسها الفقه الإسلامي إلا أن نظرية التعويض الاتفاقي قد نشأت وترعرت في كنف القانون الوضعي الأمر الذي اقتضى التوسع في العرض القانوني لكي تتضح صورته بجلاء وتبرز كنهته بوضوح، وصولًا إلى إرساء الأساس الصالح للقول بصحته بطرنه في الشريعة الإسلامية.
وقد جرى تقسيمها إلى المقدمة وفصل تمهيدي عن التطور التاريخي للتعويض الاتفاقي وموقف الفقه منه، وبابين في طبيعة الضمان، شروط استحقاق التعويض الاتفاقي وسلطة القاضي حياله وأخيرًا الخاتمة.
