يبحث هذا الكتاب في أصول المحاكمات الجزائية وطرق تحريك الدعوى العامة والقوانين الناظمة لها ودور القضاء في إقامة الدليل الجازم على توافر الضرر.
جاء الكتاب في بابين: يبحث الباب الأول في: مفهوم الدعوى العامة عبر بنود أربعة: البند الأول – طرق تحريك الدعوى العامة، البند الثاني –إدعاء المتضرر مباشرة أمام قاضي التحقيق، البند الثالث –إدعاء المتضرر مباشرة أمام القاضي المنفرد الجزائي، والبند الرابع –ممارسة الدعوى العامة من قبل النيابة العامة. كذلك يبحث هذا الباب في: القيود على إقامة الدعوى، والمرجع الذي تقدم أمامه الدعوى العامة، وسقوط الدعوى العامة.
وأما الباب الثاني فيبحث في: الدعوى المدنية أو دعوى الحق الشخصي عبر عدة عناوين مثل: مفهوم الدعوى المدنية، مبدأ تبعية الدعوى المدنية للدعوى العامة، إستثناءات مبدأ تبعية الدعوى المدنية للدعوة العامة، مقومات الدعوى المدنية، والتدخل في الدعوى المعروضة أمام القضاء الجزائي، ومتابعة النظر بالدعوى المدنية من قبل المحكمة الجزائية، رغم سقوط دعوى الحق العام بمرور الزمن، إلى آخر ذلك من إشكالات يجيب عنها هذا الكتاب عبر عرضه لقضايا وقعت فعلاً في أروقة المحاكم الجزائية في لبنان...
