تمثل الإجراءات التحفظية واحدة من أهم الإجراءات العارضة أمام محكمة العدل الدولية والإجراءات العارضة هي التي تتناول المحكمة الدولية بمناسبة نظرها لقضية معروضة أمامها، فهي ليست إجراءات مستقلة عن الدعوى، ومن هذه الإجراءات العارضة طلب التدخل الذي قد تبديه دولة ليست طرفاً في نزاع معروض على المحكمة بحجة أن لها مصلحة قانونية اقتضت هذا التدخل. ونظراً لأهمية الإجراءات التحفظية على سير الدعاوى أمام المحكمة الدولية فقد أعطى حق التأشير بها إلى المحكمة من تلقاء نفسها ولو لم يطلب الخصوم ذلك مني رأت أن ظروف القضية تقتضي الأمر بهذه الإجراءات، وتثير دراسة موضوع الإجراءات التحفظية عدة تساؤلات حول هذه الإجراءات لعل من أبرزها: مدى اعتبار هذه الأوامر المستعجلة من المبادئ العامة للقانون نظراً لكونها معروفة في أغلب النظم القانونية الداخلية في العالم؟، أما التساؤل الثاني الذي يطرحه هذا الموضوع فيدور حول ما هي الشروط التي يجب أن تتوافر للمحكمة حتى تأمر بالإجراءات التحفظية؟، ووفقاً لذلك تم تناول هذا الموضوع في ثلاثة فصول سبقها فصل تمهيدي فيه نشأة القضاء الدولي، وتطوره، ودوره في تسوية المنازعات الدولية، أما الفصول فهي: (الفصل الأول: ماهية الإجراءات الجنائية، الفصل الثاني: سلطة محكمة العدل الدولية في الأمر بالإجراءات الجنائية، الفصل الثالث: الآثار القانونية المترتبة على الإجراءات التحفظية).
