قد تقتضي طبيعة وظروف النزاع المتفق بشأنه على التحكيم ، اتخاذ تدابير فنية وتحفظية ، سواءً أكان ذلك قبل تشكيل هيئة التحكيم أم أثناء سير إجراءات التحكيم ، الأمر الذي يتطلب اتخاذ إجراءات عاجلة لحماية الحقوق والمراكز القانونية .
وقد بدأت الدراسة بمقدمة ، من خلال الفصل الأول ، وتضمنت العناصر الرئيسية للبحث ، وتناولت في الفصل الثاني ، سلطة اتخاذ التدابير الوقتية والتحفظية في الأعمال التحكيمية ، وذلك من خلال التصدي لمفهوم التدابير الوقتية والتحفظية وتحديد أهميتها في خصومة التحكيم ، وكذلك شروط الإختصاص في اتخاذ هذه التدابير سواء من قبل قضاء الدولة أو التحكيم .
وتم تناول ماهية سلطة المحكم الولائية في اتخاذ التدابير الوقتية والتحفظية ومبررات الإعتراف بهذه السلطة ، مع إشارة إلى أهم مظاهر التدابير الوقتية والتحفظية التي يمكن للمحكم اتخاذها أثناء سير خصومة التحكيم ومدى دور إرادة أطراف التحكيم في تحديد الجهة المختصة باتخاذها ، وذلك من خلال الفصل الثالث . أما الفصل الرابع ، فتم فيه بحث العلاقة بين قضاء الدولة والتحكيم بإصدار الأحكام الوقتية وطبيعة هذه الأحكام وآثارها ، من خلال بيان موقف التشريعات الوطنية والدولية ، وكذلك موقف الفقه والقضاء .
وتم تثبيت النتائج والتوصيات التي خرجت بها هذه الدراسة من خلال الفصل الخامس ، ومن أهم النتائج التي خلصت إليها الدراسة ، أن اختصاص قضاء الدولة في النظر بالتدابير الوقتية والتحفظية في الأعمال التحكيمية اختصاصاً أصيلاً ، ولا يمكن أن يسلب منه ، كما أن اختصاص قضاء الدولة بالنظر في المسائل الوقتية والتحفظية في النزاعات المرتبطة بالتحكيم ، لا يؤثر على اتفاق التحكيم ولا تعتبر إهداراً للأثر السلبي الناتج عن اتفاق التحكيم .
