قد يكون الحد من الجريمة من أهم أولويات الدولة بصورة خاصة والمجتمع بصورة عامة؛ من هنا تأتي أهمية قانون العقوبات الذي يعتبر الوسيلة الأكثر فعالية للحد من الجريمة، خصوصاً بعد تطور المجتمعات وحلول العدالة محل الإنتقام الفردي.
إن قانون العقوبات يختص بدراسة النصوص المتعلقة بالجرائم والعقوبات المقررة لها، وهو يساهم في إشاعة جو من الإستقرار الإجتماعي من خلال تحديده للأفعال الجرمية المحظورة وبيانه للجزاءات المقررة لها.
لقد أصبحت الجريمة أكثر خطراً في أيامنا الحاضرة بفعل تطور الوسائل التكنولوجية الحديثة، وبات قانون العقوبات بحاجة إلى تعديلات مستمرة لمواكبة العصر وسد حاجات المجتمع.
إن قانون العقوبات لا يحتمل الإنتظار لتطويره - كما القوانين الأخرى - حيث الإجتهاد يمكن أن يسد مسد النصوص القانونية، لأن مبدأ شرعية الجرائم والعقوبات يقف سداً منيعاً يحول دون التجريم أو إنزال العقاب بغياب النص القانوني.
إن هدفنا من هذا "الوجيز" هو إلقاء الضوء على قانون العقوبات بصورة سهلة ومقتضبة تسهّل على القارئ الفهم وعلى الممارس الإستفادة؛ كما حاولنا من خلاله أن نضيف شيئاً - ولو يسيراً - على المكتبة العربية... عسانا نكون وفقنا في مسعانا.
