في كتابه هذا قدَم الدكتور "حمادي ذويب" من تونس قراءة لأصول الفقه في التاريخ، ودرس علاقة النظرية الأصولية بالواقع الذي نشأت فيه، وبيَن مساهمة كلَ من العاملين السياسي والمذهبي على وجه الخصوص في صياغة كثير من المفاهيم والمسلمات الأصولية السائدة وقد سار في بحثه هذا على خطي المنهج الاستشراقي الذي وعى جيداً "المنزلة الأثيرة للواقع"؛ رافضاً في الوقت نفسه التسليم للمنهج الشائع الذي يدرس تاريخ أصول الفقه منفصلاً عن سياقه وبيئته، وكأنه علم عقلي خالص.
وانطلاقاً من هذه النقطة المنهجية، ينقب الدكتور ذويب في الخلفيات التاريخية للنظرية الأصولية عند أهل السنة وغيرهم، ويرصد حجم الفعل السياسي والمذهبي المؤثر في صياغتها، ليصل إلى تفكيك ما يسمى بالأدلة الأربعة (الكتاب والسنة والإجماع والقياس) وذلك من خلال إثبات الخلاف عليها بين الفرق والمذاهب، ورد حجيتها إلى عوامل الزمان والمكان والثقافة للأصوليين.
ينقسم الكتاب إلى خمسة أبواب جاءت تحت العناوين الاتية: الباب الأول: تاريخية التدوين في أصول الفقه، الباب الثاني: حجية الأصول في ضوء الواقع التاريخي، الباب الثالث: اصول الفقه الفرعية ومحاولة التكيف مع الواقع، الباب الرابع: أصول الفكر وتبرير الواقع، والباب الخامس: أصول الفقه وتكريس الانفصال عن الواقع التاريخي.
