نشأ الإجماع استجابة لحاجة تاريخية اجتماعية لكنه منذ بروزه كان عرضة للنقد لأنه تأسيس على مبادئ تتجاوز حدود البشر وإمكاناتهم، غير أن هذا النقد لم ينجح، ذلك أن الإجماع وبقية النظريات الأصولية قد استطاعت أن تضمن دوام البقاء لأن من تبناها في المجتمع وفي السلطة السياسية كان بيده الحكم والنفوذ. وهكذا غلفت هذه النظرية عبر القرون بطابع التقديس والبداهة، ولم يعد إلى مراجعتها ونقدها سبيل. غير أن العصر الحديث - وبداية من أواخر القرن التاسع عشر خاصة - بدأت الحركة النقدية للإجماع في أوساط مسلمة أو استشراقية، غير أن هذا النقد مشتت ولا توجد دراسة تحيط بأهم ما كتب فيه.
