لقد اخترنا دراسة فكر البروفسور وائل حلاق؛ لأنّه ليس كاتباً كثير الإنتاج فحسب؛ بل أيضاً من أهمّ المتخصصين في الدراسات الدائرة على الفكر الإسلامي في الجامعات الغربية، وتحديداً الجامعات الواقعة في أمريكا الشمالية.
وقد ألّف عشرات الكتب والمقالات التي يدرس أغلبُها مسائلَ تتعلّق بالفقه الإسلامي وتاريخه وفلسفته، وتشكّل النظام القضائي في الإسلام، والنظرية السياسية الإسلامية.
وقد تُرجمت بعض كتبه ومقالاته إلى لغات عدة منها: العربية والعبرية والإندونيسية والإيطالية واليابانية والكورية والفارسية والتركية.
يستحق حلاق الإهتمام؛ فقد صُنِّف ضمن الشخصيّات الخمسمئة الأكثر تأثيراً في العالم، وما يبرّر الإشتغال به كذلك أنّ الكتب، التي اهتمّت به في اللغة العربية، هي، في أغلب الأحيان، ترجمات لا دراسات.
ولم تتناول الدراسات، التي كُتبت عن حلاق، القضايا الأصولية التي درسها في كثيرٍ من بحوثه القصيرة أو الطويلة؛ لذلك رمنا تخصيص هذا الكتاب لدراسة مسائل مختارة من هذه القضايا دراسة تحليلية نقدية.
هدفنا من هذه الدراسة عرض بعض القضايا الأصولية التي خاض فيها حلاق عرضاً تحليلياً نقدياً، وبيان أنّ المباحث الأصولية ليست مقتصرة على ما يُكتب باللغة العربية؛ بل هي منتشرة في غيرها من اللغات، وأنّ إطلاع القارئ والباحث العربي على مثل هذه الدراسات يمكن أن يغني فكره، ويوسّع دائرة نظره وآليات تحليله ونقده للتراث الأصولي القديم، ويضفي عليه مسحة معاصرة.
