لقد مر القضاء الجنائى الدولى فى مسيرته الطويلة ، وعلى مر العصور وكر الدهور بعدة مراحل ، كانت كل مرحلة من مراحله انعكاسا لظروف معينة وتأثيرات قوى معينة . ولذلك فقد أدرك الإنسان من تجاربه الماضية ، أن وجود نظام فعال وقوى للمساءلة الجنائية عن العدوان على الإنسان جسداً وبيئة ومجتمعاً خاصة فى أوقات الحروب يعد من اقوى الضمانات التى تكفل لحياته ولبيئته ولمجتمعه الحماية والاستمرار . لذلك كانت مسألة إنشاء محكمة جنائية دولية من أوائل المسائل التى كانت موضوعة على أجندة الأمم المتحدة فى أول جلساتها التى أعقبت إنشائها ، بناء على الاهتمام المتزايد من قبل كافة الدول الاعضاء فى هيئة الأمم المتحدة بما فيهم الدول الخمس دائمة العضوية فى مجلس الأمن . وقد تكون النظام الأساسى للمحكمة الجنائية الدولية من ديباجه و (128 ) مادة . علاوة عن مشروع النص النهائى للقواعد الإجرائية وقواعد الإثبات الذى يتقدمه مذكرة تفسيرية وبلغ عدد هذه القواعد ( 225 ) قاعدة . إضافة إلى الصيغة النهائية لمشروع نص أركان الجرائم التى تختص بها المحكمة والواردة فى المواد ( 6 , 7 , 8 ) من النظام الأساسى ، ويتكون هذا المشروع من مقدمة عامة وبيان تفصيلى بأركان تلك الجرائم سالفة الذكر.
