لقد مر القضاء الجنائي الدولي في مسيرته الطويلة، وعلى مر العصور وكر الدهور بعدة مراحل، كانت كل مرحلة من مراحله انعكاسًا لظروف معينة وتأثيرات قوى معينة. ولذلك فقد أدرك الإنسان من تجاربه الماضية، أن وجود نظام فعال وقوي للمساءلة الجنائية عن العدوان على الإنسان جسدًا وبيئة ومجتمعًا خاصة في أوقات الحروب يعد من أقوى الضمانات التي تكفل لحياته ولبيئته ولمجتمعه الحماية والاستمرار. لذلك كانت مسألة إنشاء محكمة جنائية دولية من أوائل المسائل التي كانت موضوعة على أجندة الأمم المتحدة في أول جلساتها التي أعقبت إنشائها، بناء على الاهتمام المتزايد من قبل كافة الدول الأعضاء في هيئة الأمم المتحدة بما فيهم الدول الخمس دائمة العضوية في مجلس الأمن. وقد تكون النظام الأساسي للمحكمة الجنائية الدولية من ديباجة و(128) مادة. علاوة عن مشروع النص النهائي للقواعد الإجرائية وقواعد الإثبات الذي يتقدمه مذكرة تفسيرية وبلغ عدد هذه القواعد (225) قاعدة. إضافة إلى الصيغة النهائية لمشروع نص أركان الجرائم التي تختص بها المحكمة والواردة في المواد (6، 7، 8) من النظام الأساسي، ويتكون هذا المشروع من مقدمة عامة وبيان تفصيلي بأركان تلك الجرائم سالفة الذكر.
