تعتبر الدولة من أول وأهم أشخاص القانون الدولي العام، واستمد القانون منها الاسم، فكان دوليًا أي يختص بالدول وتصرفاتها في المجتمع الدولي، وهي أساس المجتمع الدولي بدونها لا يوجد مجتمع دولي، ورغم أهميتها الكبيرة لم تنل الدراسة في فقه القانون الدولي العام ما يناسب ذلك، فاتجه الفقهاء إلى دراسة تصرفات الدولة والحكم عليها، دون تبيان حقيقي لماهية وأركان شروط الدولة.
ومن حيث تعددت تعريفات فقهاء القانون الدولي للدولة كشخص أهم وأول شخص في القانون الدولي العام، فقد عرفها أحد الفقهاء بأنها (مجموعة من الأفراد يقيمون على سبيل الاستقرار في إقليم معين ويخضعون لسيطرة هيئة حاكمة ذات سيادة).
ومن هنا يتولى القانون الدولي تحديد الأشخاص المخاطبين بأحكامه، وبما يفرضه من التزامات ويقرره من حقوق، وفقاً للفقه التقليدي في القانون الدولي، تعتبر الدولة وحدها الشخص القانوني الذي يتمتع بالشخصية القانونية الكاملة في نظام القانون الدولي ومنذ عام 1945م عقب إنشاء الأمم المتحدة أصبح من الواضح أن القانون الدولي العام لم يقتصر على مخاطبة الدول وحدها وتحديد حقوقها وواجباتها، ولكنه اعتراف بوجود مستقل لهيئات دولية متنوعة مثل المنظمات والوكالات الدولية وكيانات أخرى لا تعد دولًا.
