من مفارقات العدالة التي تقودها المحكمة الجنائية الدولية بحق السودان ورئيسها عمر حسن البشير، أنها تحاول تكريس سوابق قانونية دولية لا محل لها من الإعراب في القانون الدولي الجنائي، إذ يبدو أنها محاولة لتكريس ازدواجية في التعامل مع قضايا تبدو في ظاهرها متشابهة رغم أن وقائعها ونتائجها مختلفة ففي سابقة في العلاقات الدولية والقانون الدولي، وفي أحد أخطر التعديلات الخارجية على السودان واستقلاله وسيادته واستقراره السياسي، طلب المدعي العام للمحكمة الجنائية الدولية لويس مورينو أوكامبو.
توجيه أول مذكرة توقيف دولية ضد رئيس دولة السودان عمر حسن البشير، ذلك بعد ستة أعوام على تأسيسها، وأربعة ملفات فتحتها ولم تغلق أيًا منها، و12 متهمًا لم تتكمن من اعتقال نصفهم، ما يطرح سابقة مثيرة للجدل لا تتوقف عند حدود القانون.
ربما قدر العرب أن يبقوا الأوائل في تسجيل السوابق من كافة الأنواع، اليوم عمر البشير عبر المحكمة الجنائية الدولية، وقبله صدام حسين عبر محكمة جنائية عراقية خاصة، وربما غدًا رئيس آخر عبر محكمة مختلطة، فإلى أين تسير العدالة الدولية ومحاكمها؟ وهل بات من صدقية يحتذى بها؟ أنها أسئلة محيرة تبحث عن أجوبة في عقول الشعوب العربية قبل حكامها.
