عقود نقل التكنولوجيا من العقود المستحدثة ، وهى نتيجة الزيادة المطردة فى العلاقات الاقتصادية الدولية . وعبور الاستثمارات حدود الدول ، وهى كذلك فى المجال القانونى الوطنى والدولى ، وهى من المواضيع الشائكة الصعبة التى تنتمى لأكثر من فرع من فروع القانون المختلفة . فلها فى القانون المدنى ، والقانون الدولى العام فرع ، وفى القانون الدولى الخاص موضوع . وفى القانون التجارى فصل ومبحث . لذلك كانت دراستها صعبة ، وتحتاج لأكثر من الدقة ، حتى تصل إلى الفكرة وكيفية بحثها ودراستها الدراسة القانونبة التى لا تبعد عن الواقع المتطور المتغير . ولعقود التكنولوجيا جانب من السياسية ، والسياسية ملح الحياة ، وهى أكثر وجوداً هنا ، حتى أنه فى كثيراً من الأحيان يفسد الصفقة ( الطبخة ) لزيادة الملح ، ويجعل نقل التكنولوجيا ما هو بنقل ، ولكنه نقل سراب وهواء مقابل نقدى كبير ، فيصل فى بعض الأحيان إلى حد الدجل السياسى طبعاً . خاصة وأن العلاقة فى عقود نقل التكنولوجيا بين تابع ومتبوع ، أى أنها علاقات غير متكافئة . ولا يخفى الجانب الاقتصادى – توأم السياسية – فى عقود نقل التكنولوجيا ، فالتكنولوجيا لها دور هام ومهم ، لا يمكن التغاضى عنه أو استبداله ، إذا أرادت دولة ما تنمية اقتصادية حقيقة متصاعدة ، وقد اكدت على ذلك كافة الاتفاقيات الدولية التى تعرضت لعقود نقل التكنولوجيا بالتنظيم القانونى على المستوى الدولى ، وظهر ذلك جلياً فى جهود الأمم المتحدة ووكالاتها المتخصصة ، وفى مؤتمر الامم المتحدة للتجارة والتنمية .
