وفي ربيع الثاني سنة 566 هـ ولاّه الخليفة العباسي المستضيء بأمر الله منصب قاضي القضاة ببغداد رغم رفضه وامتناعه، وقد بقي في منصبه حتى وفاته في 15 محرم 570 هـ.
