تحاول هذه الدراسة تتبع منصب قاضي القضاة وإبراز أهميته الاجتماعية والسياسية في العاصمة بغداد خلال العهدين البويهي والسلجوقي. وهو موضوع كان قد أهمله المؤرخون رغم أهميته في تسليط الأضواء على التكوين السياسي والاجتماعي في القرون الوسطى.
وباعتقادي أن قيمة الدراسة تكمن في الأسباب التالية: أولاً: لأن منصب قاضي القضاة وظيفة حكومية، كان عليه أن يعكس سير الأحداث ويعتبر كل تعيين في أي وظيفة بمثابة خطوة سياسية بمبادرة من قبل السلطة الحكومية.
ثانياً: أن تطور منصب قاضي القضاة كان مرتبطاً ارتباطاً وثيقاً بمصير الخلافة الإسلامية في صراعها ضد السلالتين الأجنبيتين الحاكميتن البويهية والسلوجية. ولم يكن فهم حقيقة صراع الخلافة الإسلامية من أجل الحفاظ على سلطتها على بغداد ممكناً دون التأمل العميق بالتغيرات التي طرأت على السلطة القضائية.
ثالثاً: إن الاهتمام بمنصب قاضي القضاة لم يقتصر على بعده السياسي فحسب، بل لكونه تطور ونما كدائرة حكومية. فلقد استطاعت السلطة القضائية أن تتطور من التبعية الشاملة للوزير أو الحاكم الأموي إلى الاستقلالية والقدرة على تحدي الوزارة نفسها إبان حكم السلاجقة.
