لم يعرف المسلمون منصباً خاصاً بالقاضي حتى شره عمر بن الخطاب رضي الله عنه بعد توليه الخلافة في تنظيم القضاء، إذ إليه يعود الفضل في تعيين القضاة، فكان أن سار على منواله من جاء من بعده، وحتى إذا جاء العصر الأموي تطور الأمر وخرج عن حدود القضاء الذي كان مكلفاً النظر في أحوال المتخاصمين وفي المشاكل التي يعجز القاضي عن حلها.
أما العباسيون فقد نحى القضاء في عهدهم منحى جديداً يتناسب وتطور الحياة وتعقد أساليبها. فنظم الرشيد القضاء واستحدث نص قاضي القضاة، وقلده لأبي يوسف الأنصاري. واستمر هذا التقليد سارياً في كل الدول الإسلامية التي قامت بعد ذلك سواء في مصر أو الأندلس. وبالرغم من كثرة من كتب عن القضاء في الإسلام وأحواله فقد ندرت الدراسات التي بحثت موضوع القضاء من خلال سيرة القضاة أو قضاة القضاة.
والكتاب الذي بين يدينا يتناول بشكل مباشر أعلى منصب قضائي في الإسلام وهو محاولة للرد على من حاول تشويه سيرة قضاة المسلمين بهدف تشويه صورة الإسلام والمسلمين. والكاتب هنا يتبع سيرة بعض من تقلد منصب قاضي القضاة كأبي يعقوب بن إبراهيم بن حبيب، ويحيى بن أكثم، وأبي السائب الهمزاني، وابن خلكان، وأبي الحسن البصري وغيرهم. كما تطرق إلى ذكر أسماء من تقلد منصب قاضي القضاة في العواصم العربية الإسلامية من بغداد إلى القاهرة ثم دمشق مقرطبة، وقد تتبع أخبار أولئك القضاة من مصادرها الأصلية بعد أن أعمل فيها التدقيق والمقارنة بغية إخراجها بالشكل الذي يتلاءم مع متطلبات القارئ.
