Book Description
العقود المسماة أو العقود الخاصة، هي التي أفرد لها المشترع أحكاماً وتسمية خاصة تميزها عن غيرها من العقود كعقد البيع وعقد الهبة، وعقد الوكالة وعقد الضمان. ومجالات العقود المسماة أو الخاصة تعتبر في إطار القانون المدني على جانب كبير من الأهمية. كما أن هذه العقود المسماة ليست جامدة من حيث عددها فهناك عقود قد يندر أو يتوقف التعامل بها، وهناك عقود قد ترى النور بفعل تطور المجتمع وتغير الأزمنة.
وفي هذا الكتاب يقدم المؤلف دراسة معمقة ومقارنة لأحكام القانون اللبناني والفرنسي وكذلك التشريع المصري، وبعض التشريعات العربية الأخرى التي تنظم هذه العقود وتنظم المبادئ العامة التي ترعى العقود والعناصر الأساسية للعقود وشروط صحتها. إضافة إلى تعزيز الكتاب بما يناهز الألفي قرار وحكم من الاجتهاديين اللبناني والفرنسي قديمهما وحديثهما المتعلقة بهذا النوع من العقود.
وقد زود الكتاب بملحق أورد المؤلف فيه النص الحرفي لمشروع قانون الإيجارات الجديد الذي أقرته لجنة الإدارة والعدل النيابية. ورغم أن هذا الكتاب فخصص لطلبة المعاهد القضائية وكليات الحقوق إلا أنه يلبي أيضاً حاجة العاملين في مجال المحاماة والقضاء ويسد نقصاً في المكتبة العربية طالما دعت الحاجة إلى سده.
