منذ أن عاش الإنسان في جماعة ظهرت الحاجة ماسة إلى تبادل السلع والخدمات ولذلك أو ما تبادر إلى ذهن الإنسان كوسيلة لتبادل الأموال كانت المقايضة. فالمقايضة ليست إلا مبادلة سلعة بسلعة أخرى فكان المرء يقوم بمبادلة ما يفيض عن حاجته بما هو في حاجة إليه لدى الآخرين لكن ما لبث أن ظهر قصور هذه الوسيلة عن تلبية كل الحاجات، خاصة عندما تعقدت الحياة وزادت مطالب الناس، فلم يكن من السهل دائماً إيجاد التوافق بين رغبات المقايضين وحاجاتهم.
وعندما ظهرت النقود كمقياس للقيمة لتلبي هذه الحاجات ظهرت معها فكرة البيع. ولذلك شاع البيع وانتشر وذلك لسهولته واستجابته للحاجات المتعددة والمتجددة في الوقت الذي تضاءلت فيه أهمية المقايضة وبالتالي ندر الالتجاء إليها. وإذا كانت القواعد المنظمة لعقد البيع تعتبر قواعد خاصة بالنسبة للنظرية العامة للالتزامات فإنها تعتبر قواعد عامة تحكم كل أنواع البيوع، مدنية كانت أو تجارية، عقارية، أو منقولة، فهي تعتبر الشريعة العامة لعقد البيع أياً كان محله وأياً كان وصفه، بل وفي بعض الأحيان يحيل إليها المشرع بالنسبة لبعض المسماة الأخرى عندما تتشابه الالتزامات فيها مع التزامات عقد البيع، في إطار هذا العقد يأتي الكتاب الذي بين يدينا والذي يهتم بتوضيح كل ما يتعلق بعقد البيع من انعقاد هذا العقد وشروط صحته وآثاره، كما ويتوقف بداية عند التعريف بعقد البيع ومفهومه.
