نبذة النيل والفرات: يعتبر عقد البيع في القانونين المصري واللبناني عقداً ناقلاً للملكية. ويمتاز تعريف القانون المصري لعقد البيع بأنه لا يقتصر موضوع البيع على نقل ملكية شيء، بل يبين أن البيع كما يرد على ملكية شيء، قد يرد على حق من الحقوق المتفرعة عن الملكية كحق الارتفاق أو حق الانتفاع، أو على حق شخصي. أما تصور تعريف البيع في القانون اللبناني، فلا يعني أن هذا القانون لا يتصور أن يرد البيع إلا على شيء، بل الواقع أن هذا القانون يصرف موضوع البيع إلى مختلف الحقوق المالية. وهذا الكتاب يعرض للعقود المسماة والعقدي البيع والمقايضة وهو في قسمين أو كتابين. الكتاب الأول: في عقد البيع ويتناول ثلاثة أمور هي: طبيعة عقد البيع، وخصائص عقد البيع، واشتباه عقد البيع بغيره من العقود. وفي الباب الأول يركز المؤلف على أركان عقد البيع، التي تتمثل في رضا المتعاقدين، والمبيع وهو موضوع التزام البائع، والثمن وهو موضوع التزام المشتري. ويتناول الباب الأول أحكام عقد البيع فكما يترتب على البيع نقل الملكية، فيترتب عليه كذلك التزامات في ذمة كل من المتعاقدين باعتباره من العقود الملزمة للجانبين. وأما القسم الثاني من الكتاب أو ما يسميه المؤلف الكتاب الثاني، فهو يدور حول عقد المقايضة وهو عقد به يلتزم كل من المتعاقدين أن ينقل إلى الآخر، على سبيل التبادل، ملكية مال ليس من النقود.
