إنه كتاب يتضمن جمع وتنسيق اجتهادات المحاكم المغلقة بحل المشاكل والنزاعات المثارة في نظام الإفلاس الذي يتّسم بطابع القسوة والخطورة كونه يطال المرء بشخصه وماله وعلاقته مع الغير مع ما لهذه العلاقة من تشابك وتفرعات. والكتاب إضافة إلى ما تقدم، يقدم لكل محبي الاطلاع فكرة واضحة عن التدابير والإجراءات التي يستتبعها حكم الإفلاس وهي تدابير صارمة بإمكانها أن تمسّ بحقوق أحد المتعاملين مع المفلس ولكنها في النتيجة تؤدي إلى المساواة بين دائني المفلس، فلا يفضّل أحدهم على الآخر إلا بما تضمنته القوانين من امتيازات خاصة أو عامة.
ولعل أهمية الكتاب تكمن في معالجته للنقص والتغيرات في نظام الإفلاس عن طريق الحلول المعتمدة لها من قبل المحاكم مستلهمة في ذلك المبادئ التي يرتكز إليها النظام المذكور لا سيما المبدأ الأساس ألا وهو مبدأ المساواة بين الدائنين. فعسى أن يعمد المختصين بالتشريع إلى استلهام ما تضمّنته هذه الحلول لسدّ هذا النقص وهذه التغيرات.
