إن نصوص العقود والدعاوى- في رأينا- من أبرز الأشكال التي يتجلى فيها تحول القانون إلى منجز واقعي، فهي تخضع في صياغتها إلى قواعد مخصوصة، إذ هي بناء شكلي لغوي يجسد في مستوى أول علوية القانون وشموليته، وعبر هذه الصيغ الموحدة في الغالب تتأكد النزعة النموذجية المعيارية، والإلزامية للقانون وفي ذلك وجه من أوجه ما يسنى بعملية: "التأثير بالقول".
وقد خصص القسم الأكبر من الكتاب الذي نقدم له للدعاوى، وقد اجتهد الكاتب في الإلمام بمختلف صيغ الدعاوى. وهي لغة: "المطلب". يسلمنا ذلك إلى العلاقة بين العقود والدعاوى، فالدعوى- كما العقد- وجه من أوجه العلاقات القانونية بين الأفراد غير أنها لا ترسم لنا مرحلة الاتفاق وإنما هي ما يستخدم عند التنازع، والدعاوى أصناف تختلف وتتعدد بتعدد واختلاف أنماط العلاقات القانونية التي يمكن أن تنشأ بين الأفراد، وباختلاف مضامينها، أولًا ويتبدل المجال القانوني الذي تتصل به، وباختلاف المجال الاجتماعي الذي تطاله أيضًا، أو الذي يروم صاحب الدعوى فيه الحصول على حق ما.
هذا ما يمكن أن ندركه بالنظر في كتاب صيغ العقود والدعاوى، فهناك دعاوى جنائية، وأخرى إدارية، وثالثة تجارية، ورابعة تتصل بالأحوال الشخصية كما أن هناك دعاوى مستعجلة، وأخرى بحرية وضريبية، وثمة دعاوى المرافعات، والدعاوى العمالية، والدعاوى المدنية.
