يتناول هذا البحث بالدراسة "الحماية الجنائية لسوق الأوراق المالية"، وتلك الحماية لها شقان: موضوعي يتعلق بالأفعال التي تعد جرائم والعقوبات المقررة لها، وإجرائي يتعلق بالإجراءات التي يتم إتباعها لتوقيع العقاب.
وتكتمل الحماية الجنائية بهذين الشقين لارتباط كل منهما بالآخر ارتباطاً وثيقاً باعتبارهما وجهين لعملة واحدة؛ فالإجراءات الجنائية هي الوسيلة الضرورية لتطبيق قانون العقوبات، ونقله من حالة السكون إلى حالة الحركة؛ لذا فالحماية الكاملة لسوق الأوراق المالية تتطلب إتقان المشرع للقواعد الموضوعية والإجرائية الخاصة بهذه الجرائم.
وتكتسب هذه الدراسة أهميتها من خلال الدور الفعال لسوق الأوراق المالية في الإقتصادات المعاصرة باعتبارها محل الحماية الجنائية، خصوصاً في ظل النظام الإقتصادي العالمي الجديد المتصف بالعولمة في إطار إتفاقية الجات التي وافقت عليها مصر عام 1997م.
وتهديد إنتهاكات سوق الأوراق المالية لكافة الأفراد والمؤسسات، سواء أكانت وطنية أم دولية، بل إنها تشكل مساساً بسيادة الدول على الأموال الموجودة بها، الأمر الذي يؤدي عند حدوث أي مساس بها أو انتهاك لنظمها إلى حدوث آثار وخيمة سواء على المستوى الإجتماعي أو السياسي أو الإقتصادي.
وللإحاطة بموضوع الدراسة بدور القانون الجنائي في حماية سوق الأوراق المالية، توزع الكتاب وفق ما يلي:
