الحق هو ثبوت قيمة معينة لشخص بمقتضى القانون، مما يخوّله أن يمارس سلطات معينة يكفلها له القانون. والحق العيني حق يتمثّل في سلطة لشخص تنصب مباشرة على شيء مادي معين كحق الملكية. وبذلك يستطيع صاحبه أن يباشره دون حاجة إلى وساطة شخص آخر. والحقوق العينية تنقسم هي أيضاً إلى حقوق عينية أصلية وحقوق عينية تبعية، ويمتاز الحق العيني، بخاصتين جوهريتين هما التتبع والتقدم. وموضوع هذه الدراسة التي يضمها هذا الكتاب هو الحقوق العينية الأصلية؛ وسينقسم الكلام فيها إلى قسمين، القسم الأول: حق الملكية؛ القسم الثاني: الحقوق المتفرعة عن الملكية. وحق الملكية يتألف من بابين، الباب الأول يتناول حق الملكية بوجه عام، ويتحدد البحث هنا في موضوعين: تحليل ومدى حق الملكية، والملكية الشائعة.
يعرض المؤلف من خلالها لنطاق حق الملكية والقيود التي ترد على حق الملكية. أما الكلام في الحقوق المتفرعة عن الملكية فينحصر الكلام خلاله في الحقوق المتفرعة عن الملكية في القانون المصري والقانون اللبناني وحيث يعرض المؤلف لحق الانتفاع وتحليل ومدى حق الانتفاع وأسباب كسب حق الانتفاع، كما يتناول أيضاً الحقوق المتفرعة عن الملكية في القانون اللبناني، وحق السطحية وحق ملكية الأبنية والمنشآت والأغراس.
