تتعلق هذه الدراسة بموضوع هام من موضوعات القانون المدني ألا وهو الحقوق العينية الأصلية. وينصرف اصطلاح الحقوق العينية الأصلية إلى حق الملكية وما يتفرع عنه من حقوق. وهذه الدراسة لا تتناول سوى الملكية الخاصة، أو ما يطلق عليها "الملكية الفردية" وهي التي تثبت لشخص من أشخاص القانون الخاص، طبيعياً كان أو معنوياً.
وقد نظم القانون المدني المصري الحقوق العينية الأصلية في الكتاب الثالث من القسم الثاني في المواد 802-1029 وفي القانون اللبناني نظم المشرع الحق العيني العقاري بالقانون رقم 3339 في 12 تشرين الثاني 1930 والمسمى بـ "قانون الملكية العقارية" علاوة على المادة 539 موجبات وعقود التي أقرت ضمناً وجود حق الاستعمال وحق السكنى، والمادة الأولى من القرار رقم 12 L.R في 15 كانون الثاني 1934 بشأن نظام المساقاة وأخيراً قانون إزالة الشيوع رقم 16 الصادر في 6 آذار سنة 1982، وقانون تنظيم الملكية المشتركة في العقارات المبنية الصادر بالمرسوم الاشتراعي رقم 88 في 16 أيلول سنة 1983.
وتنقسم هذه الدراسة إلى قسمين رئيسين: القسم الأول: أحكام الحقوق العينية الأصلية. القسم الثاني: مصادر الحقوق العينية الأصلية.
