هذا الكتاب محاولة متواضعة لسبر أغوار النظم العقابية قديمها ومعاصرها في سياق تأريخ مبسط يبرز ماهيتها ويوضح مبرراتها، وعوامل تبدلها وتطورها.
وقد قسم الكتاب إلى بابين رئيسين، تناول الأول منهما نشأة النظم العقابية وتطورها في المجتمعات القديمة، حيث عرض للنشأة الأولى لتلك النظم في أحضان المجتمعات البدائية، وتحسن تطورها المواكب لتطور المجتمع البشري ذاته وانتقاله من مرحلة إلى مرحلة أخرى أكثر رقياً وتهذباً، ومن ثم تلمس الصورة التي صارت عليها النظم العقابية في ظل المجتمع البشري التالي للمجتمع البدائي، والذي سمي المجتمع القديم.
وأخيراً تناول المرحلة الثالثة والأخيرة في مراحل نشأة وتطور النظم العقابية في المجتمعات القديمة حيث عرض لنظم العقاب خلال العصور الوسطة، موضحاً السمات المميزة لتلك العصور وتأثيرها البارز على النظم العقابية المطبقة فيها.
