عبر العصور التاريخ، مر العقاب وفلسفته بصور متعددة وحالات متباينة كان أبرزها التركيز على هدف إخافة الآخرين وردعهم وصرفهم عن سلوك سبيل الجريمة، وهذا ما عكسته قسوة العقوبات وشدتها، بل وبشاعتها في كثير من الأحيان أبان تلك الحقب الزمنية الأولى، حتى قيل أن الهدف الأول للعقاب لم يكن سوى الثأر والإنتقام...
وبتقدم المجتمعات وتدرجها في سلم الحضارة وإرتقائها في مدارج المدنية، بدا ذلك النزوع نحو الهدف الإصلاحي والنأي به عن البشاعة والقسوة، جلياً.
فظهرت العديد من المدارس الفكرية التي نادت ومنذ القرن الثامن عشر بالتخفيف من تلك القسوة والتركيز على هدفي الإصلاح والتأهيل العقابيَيَن، وهو ما عرف فيما بعد بــ(وظيفة الردع الخاص للعقوبة) والتي تعد أحدث أهداف العقاب بل وأبرزها وأهمها.
حتى أن العديد من المدارس الفكرية العقابية المعاصرة قد جعلت من مطلب الإصلاح العقابي متقدماً على وظيفتي العقوبة الأخرتين في الردع العام والعدالة، بل وجعلت من هذا "الإصلاح" هدفاً وحيداً للعقاب.
لهذا كان هذا الكتاب الذي تناول هذه الوظيفة الهامة للعقاب وهي "الردع الخاص"، والذي توزعت مباحثه على بابين، خصصنا الأول لبحث هذه الوظيفة للعقاب من حيث تعريفها وتمييزها عن الردع العام ومكانتها التشريعية وأهم الإتجاهات الفكرية بشأنها بين من ينكرها ومن يؤيدها ثم بيان موقف الشريعة الإسلامية من الردع الخاص العقابي.
وهذا ما يمكن أن نسميه الإطار النظري للموضوع، أما الباب الثاني فتناولنا فيه أهم النظم الإصلاحية التي بتطبيقها تتحقق هذه الوظيفة العقابية، ومن أهم هذه النظم: التعليم والعمل والتهذيب الديني والخلقي والرعاية الصحية والإجتماعية، وهي نظم يتم تنفيذها داخل أسوار المؤسسة العقابية، أما تلك التي تنفذ خارج تلك المؤسسات "جزءاً أو كلاً" فأهمها أنظمة؛ وقف تنفيذ العقوبة والإختبار القضائي والإفراج الشرطي والرعاية اللاحقة والبارول.
وقد سبق بحث ذلك عرضٌ لأهم النظم السابقة عليها وهي نظامي الفحص والتصنيف، وهو ما يمكن أن نسميه بالإطار الإجرائي لموضوع البحث.
