الدفع بسبق الإدعاء من الدفوع الإجرائية التي تثار في بدء المحاكمة لإعلان عدم قانونية المحاكمة الجارية أو وقف سيرها. مما يعني أنه يقتضي الإدلاء بسبق الإدعاء قبل المناقشة بالأساس "in limine letes" وينبغي لوجود سبق الإدعاء أن تكون هناك دعويان متحدتين كلياً في أركانهما وأن تكون المحكمتان المرفوعة إليهما الدعوى مختلفتين وكلاهما مختصتين بنظرها.
ولقيام الدفع بالتلازم ينبغي أن تكون هناك دعويان مرتبطتان برابطة وثيقة وعالقتان أمام محكمتين مختلفتين ومختصتين بنظر الدعوى المرفوعة إليهما. ويختص هذا الجزء وهو التاسع من الموسوعة القضائية بإبراز الآراء الفقهية أو الاجتهادات القضائية التي تمحورت حول موضوع سبق الإدعاء، وكما ويقدم الكتاب دراسة مختصرة تعرف بسبق الإدعاء وبشروطه وتبين التباين الحاصل بينه وبين عدم الصلاحية.
