لكل جريمة عقوبة محددة في نص القانون والعقوبة هي الجزاء الذي يقع على الجاني جزاء مسؤوليته في الحالات العادية ولكن قد تتوفر في الجريمة ظروف مشددة تجعل العقوبة العادية غير كافية بالنسبة إلى خطورتها.
لذلك، فإنّ الظروف المشددة للعقوبة هي حالات تُوجب على القاضي أو تُجيز له الحكم بعقوبة تجاوز الحدّ الأقصى لعقوبة الجريمة أو الحكم بعقوبة من نوع أشد، حيث تنقسم تلك الظروف إلى ظروف مشددة عامة يكون موقعها في القسم العام من قانون العقوبات، وهي تسري على الجرائم كافة، وإلى ظروف مشددة خاصة يكون موقعها في القسم الخاص من قانون العقوبات حيث ينص عليها بمناسبة النص على جريمة.
هذا ويترتب على تحقق تلك الظروف تشديد العقوبة وجوبيّاً أو جوازيّاً إما يتجاوز الحدّ الأقصى، وإما بتطبيق عقوبة من نوع أشد، وهي على مرِّ الدوام، ظروف قانونية لا تكون إلا بنص، إذ إنّه ومما لا شك فيه أن لظروف الجريمة أهمية بالغة في مجال قياس جسامة الجريمة وتطبيق العقوبة المناسبة للجريمة ومرتكبها؛ حيث تُعد الظروف المشددة من أهم وسائل التفريد التشريعي والقضائي للعقاب، كما أنها تؤثر في طبيعة الجريمة، وتحسين نوعها، وردّها إلى فصيلتها التي قد تكون من الجنايات أو الجنح أو المخالفات، فضلاً عن أن للظروف المشددة أثراً على المساهمين في الجريمة.
