تنبني هذه الدراسة، على مفردات استحقاق العقوبة الجنائية، الإنسان المكلف، والأثر القانوني لافتراض البراءة، وأسباب تغليظ العقوبة الجنائية، ما كان منها ظرف عام وظرف خاص، وماهية الظروف العينية المشددة للعقوبة، وتقف على المردود القانوني لأسباب تشديد العقوبة، فتطرح أثر أسباب التشديد على العقوبة وعلى طبيعة الجريمة، وأهمية التمييز بين فاعل الجريمة والمساهم فيها، ومن ثم يتبين أثر الظروف العينية والظروف الشخصية التي قد تلحق بالفاعل، أو بالفاعل مع غيره، وبالشريك، ذلك أنه مما يضير القواعد التي تدار العدالة بمقتضاها أن تعامل المتهمين بوصفهم نمطًا ثابتًا أو اعتبارهم نمطًا واحدًا يصب في قالب جامد، فالأصل في العقوبة هو تفريدها دون تعميمها، إذ من غير المتصور أن تتوافق ظروف الجناة كافة وأن تتساوى عقوبتهم فلا تغاير فيها، وفي ذلك إيقاع جزاء في غير ضرورة وبما يفقد العقوبة تناسبها ووزن الجريمة وما أحاط بها من ظروف، عينية وشخصية على السواء، ذلك أن الجزاء كلما كان بغيضًا أو عاتيًا لا يكون مبررًا، أن مناط مشروعية العقوبة مرهون بأن يباشر قضاء الحكم مجال تدرج العقوبة وتجزئتها في الحدود المقررة قانونًا، فذلك وحده الطريق إلى معقوليتها وإنسانيتها.
