بعد عدة سنوات من تدريس مادة القانون المدني بشقيها النظري والعملي أحببت هذه المادة بصدق وبشغف وقررت أن أكتب فيها فكان هذا المؤلِّف المتواضع تواضع سنوات خبرتي.
تنقلت كما النحلة من كتاب إلى آخر وكانت الحصيلة ما وضعته بين أيديكم كتاب أسميته "دروس في القانون المدني" عالجت فيه بعض من النظرية العامة للموجبات بأسلوب تميز بالبساطة والوضوح شكلاً ومضموناً.
لا أدعي بأنني لامست النجوم أو عانقت السماء ولا أدعي بأنني تفوقت على من كتب في النظرية العامة للموجبات وكلهم أساتذة كبار أحترم وأجل لا بل أعترف بكل صدق وأمانة بأنني تأثرت واستفدت كثيراً مما كتبه الآخرون.
وترجمت هذه الفائدة عملياً من خلال وضع هذا المؤلِّف الذي عالجت فيه تباعاً وفي ثلاثة أجزاء نظرية الموجبات في القانون اللبناني والتشريع المقارن، فبحثت في مركز النظرية العامة للموجبات، وأهميتها من الناحية العملية والعلمية وفي أنواع الموجبات وفي مصادر الموجبات شروط صحتها.
وسعيت من خلال التقسيم الذي اعتمدته إلى تمكين القارئ من الإحاطة بالنظرية العامة للموجبات بكل أبعادها.
فخصصت الجزء الأول: للنظرية العامة للموجبات - تعريف الموجب وبيان أنواعه - مصادر الموجبات: القانون - الكسب غير المشروع - العمل القانوني المنفرد.
والجزء الثاني: للعقد، والجزء الثالث: للأعمال غير المباحة (المسؤولية المدنية).
أيها الباحث في القانون المدني طالباً أو محامياً أو قاضياً أضع أمامك هذا المرجع الغني بالآراء الفقهية والإجتهادات القضائية اللبنانية والفرنسية القديم منها والحديث على حد سواء.
وعسى أن تجد فيه ما يساعدك على سبر غور النظرية العامة للموجبات بكل تشعباتها، وبكل ما تطرحه من أسئلة راجية من الله تعالى أن أحصد نتيجة ما سعيت إليه وأن أقدّم ما يروي ولو قليلاً ظمأ كل متعطش لمعرفة بعض من جوانب النظرية العامة للموجبات.
