ان من طبيعة العقود الادارية انها تحقق توازنا بين الاعباء التى يتحملها المتعاقد مع الادارة وبين المزايا التى يتمتع بها ومن اجل تحقيق فكرة التوازن المالى للعقد فقد ابتدع مجلس الدولة الفرنسى ثلاث نظريات من شانها الحفاظ على هذا التوازن وهى نظرية عمل الامير ونظرية الصعوبات المادية غير المتوقعة ونظرية الظروف الطارئه وكان متبغى ذلك هو تحقيق العدالة والمصلحة العامة ايضا عن طريق عدم توقف المتعاقدين مع الادارة عن تنفيذ التزاماتهم التعاقدية ونظرية الظروف الطارئة فتطبق فقط اذا طرات حوادث استثنائية عامة كالحروب او الزلازل او الفيضانات وغيرها ويشترط لتطبيق هذه النظرية ان يصل الضرر الى درجة ارهاق المتعاقد وان يؤدى الى قلب اقتصاديات العقد راسا على عقب ولقد تميزت هذه النظرية اكثر من النظريتان السابقتان ولهذا فقد كان هذا الكتاب لدراستها والالمام بها والاحاطة بتفصيلاتها والقاء الضوء على جوانبها القانونية والفنية من حيث نشأتها واساسها ومجال ونطاق تطبيقها والنتائج التى تترتب على هذا التطبيق .
